Agreement to our Terms of Service

We are Helios Store (‘Company’, ‘we’, ‘us’, or ‘our’). 

We operate the website heliosstore.co.uk (the ‘Site’), as well as any other related products or services that refer or link to these Terms of Service (collectively, the ‘Services’).

These Terms of Service constitute an agreement between you, whether personally or on behalf of an entity (‘you’), and Helios Store concerning your access to and use of the services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by these Terms of Service. If you do not agree with these Terms of Service, then you may not access the website or use any of its Services. 

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service from time to time. We will alert you to these changes by updating the ‘Last Updated’ date on this page. It is your responsibility to check this page periodically for updates. You will be subject to, and will be deemed to have been made aware of and to have accepted the changes in any revised Terms of Service by your continued use of the Services after the date such revised terms are posted. 

The services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services. 

Our store is hosted on Squarespace, Inc. They provide us with the e-commerce platform for the sale of our products and services to you. 

1. Use of Our Services

You may only use our services for lawful purposes, and you may not use them in a way that infringes the rights of anyone else or that restricts or inhibits anyone else's enjoyment of our Services. You may not use the content of the Website or our Services for any commercial purposes whatsoever.

Except where otherwise specified on this Website, the materials on this Website are displayed solely for the purposes of promoting Helios Store products and services available in the UK. However, Helios Store may accept orders for delivery to locations outside of the UK, subject to customs, legal, regulatory and certain practical restrictions. Those who choose to access this Website from locations outside the UK or place orders for delivery to locations outside the UK are responsible for compliance with local laws if and to the extent local laws are applicable.

2. Your Submissions

Please review this section and the ‘Prohibited Activities’ section carefully before using our Services to understand the (a) rights you give us and (b) obligations you have when you submit an enquiry, post or upload any content through our Services. 

By directly sending us any questions, comments, suggestions, ideas, feedback, or other information about our Services (‘Submissions’), you agree to assign to us all intellectual property rights in such Submission. You agree that we shall open this Submission and be entitled to its unrestricted use and dissemination for any lawful purpose, commercial or otherwise, without acknowledgement or compensation to you. 

You are responsible for what you post or upload: By sending us submissions through any part of the Services, you:

  • confirm that you have read and agree with our ‘Prohibited Activities’ and will not post, send, publish, upload or transmit through the Services any submissions that are illegal, harassing, hateful, or harmful, defamatory, obscene, bullying, abusive, discriminatory, false, inaccurate, deceitful, misleading or threatening to any person or group;

  • warrant that any such submissions are original to you or that you have the necessary rights and licences to submit such submissions and that you have full authority to grant us the above-mentioned rights in relation to your submissions; and

  • warrant and represent that your submissions do not constitute confidential information.

You are solely responsible for your Submissions and you expressly agree to reimburse us for any and all losses that we may suffer because of your breach of (a) this section, (b) any third party’s intellectual property rights, or (c) applicable law.

3. Our Products

We make every effort to display as accurately as possible the colours, features, specifications and details of the products available on the Website. However, we do not guarantee that the colours, features, specifications, and details of the products will be accurate, complete, reliable, current or free from other errors, and your electronic display may not accurately reflect the actual colours and details of the products. All products are subject to availability, and we cannot guarantee items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change. 

4. Errors and Omissions

From time to time, the information provided on our website or within the Service may contain errors, inaccuracies, or omissions related to product details, pricing, promotions, offers, shipping charges, delivery times, or availability. We reserve the right to correct such errors, inaccuracies, or omissions, and to update or modify information or cancel orders at any time and without prior notice, even after an order has been placed, if any information within the Service or on any affiliated website is found to be inaccurate.

We are under no obligation to update, revise, or clarify any information in the Service or on any related website, including but not limited to pricing details, unless required by applicable law. Any specific update or revision date shown in the Service or on a related site should not be interpreted as indicating that all content has been updated or reviewed.

5. Orders and payments

If we cannot supply you with the product or service you ordered, we will not process your order, inform you of this via email and, if you have already paid for the product or service, refund you in full as soon as reasonably possible.

If the fulfilment of an order (or any aspect of it) would be illegal or unlawful, including by reason of breach of export controls or sanctions rules, Helios Store has the right to stop or cease to fulfil the order at any time, including after despatch of products and/or notification to you that the order has been received and is being processed. You acknowledge that Helios Store shall incur no liability in such circumstances.

During the checkout process, you will be asked to enter your payment details. Where you are using either credit or debit card, by completing your payment details you confirm that the credit or debit card being used is yours. All fields indicated as compulsory must be completed. Please note that we may collect and store your information, using an encrypted secure payment mechanism and will only use your information in accordance with our Privacy Policy. All card payments are subject to authorisation by your card issuer. 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we will attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. 

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

6. Returns policy

Please review our Returns Policy before making any purchases. 

Products lost or damaged in transit

If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.

Statutory Rights in relation to Faulty Products

The statutory rights in relation to faulty products apply to online orders from the date of delivery. 

Your statutory rights are as follows:

  • Within 30 days of delivery/purchase of the product, you may exercise the right to a refund if the product purchased is not of satisfactory quality, fit for purpose or as described.

  • After the 30 day period, but within six months of delivery/purchase and where the product is faulty, you are entitled to a repair or replacement. Where repair or replacement is not possible, or the repair or replacement does not resolve the fault, you are entitled to a refund.

  • After six months of delivery/purchase, similar rights exist, but only if you can prove that the fault was present at the point of delivery/purchase. In addition, if repair or replacement does not resolve the fault, we may make a deduction from any refund for fair use.

Your right to cancel

If you are contracting with us as a consumer online, you have the right to cancel your contract at any time up to 14 calendar days after the day on which you receive the products you ordered.

For example, if you receive your order on a Monday, you have 14 days from Tuesday to notify us of your cancellation. To cancel your order, you must let us know in writing, which you can do by emailing us at info@heliosstore.co.uk or by submitting an enquiry via our Contact Form.  Refunds for orders cancelled under the Regulations will be processed in accordance with your statutory rights. You must take good care of the items while they are in your possession and they must be returned to us as soon as possible at your cost. 

7. Delivery Policy

Please review our Delivery Policy before making any purchases.

Delivery will be to the UK or international address specified in your order. 

Free delivery applies within the UK for orders over £50. All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order. We shall be under no liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.

International Delivery
Due to customs, legal, regulatory and certain practical restrictions applicable to orders placed for international delivery, some of our products may not be available for delivery to certain destinations outside the UK. Helios Store reserves the right to define what can and cannot be delivered to which destination.

The recipient may have to pay import duty or a formal customs entry fee before or on delivery. Additional taxes, fees or levies may apply according to local legislation and customers are required to check these details before placing an order for international delivery. Where applicable, it will be your sole responsibility to comply with any export controls or sanctions rules applicable to goods supplied to you.

Delays

Where the supply of your product(s) or service(s) is delayed or prevented for reasons beyond our control (for example, material shortages, import delays or higher than anticipated demand) we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.

8. Third-party links

Some content, products, and services available through our Service may include materials provided by third parties. Links to third-party websites found on our site may lead you to platforms that are not affiliated with us. We do not assume responsibility for reviewing or verifying the content or accuracy of these third-party sites, and we make no warranties and accept no liability for any third-party materials, websites, products, or services.

We are not responsible for any loss, damage, or issues arising from the purchase or use of goods, services, resources, or content from third-party websites. It is your responsibility to review and understand the third party’s policies and terms before engaging in any transactions. Any questions, concerns, complaints, or claims regarding third-party products should be directed to the relevant third party.

9. Prohibited activities

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. 

We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

10. Privacy Policy

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy policy, which is incorporated into these Terms of Service. Please be advised that the Services are hosted in the United Kingdom. If you access the Services from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the United Kingdom, then through your continued use of the Services, you are transferring your data to the United Kingdom, and you expressly consent to have your data transferred to and processed in the United Kingdom.

11. Limitation of Liability

We do not guarantee, represent, or warrant that your use of the Service will be uninterrupted, timely, secure, or free from errors. We also make no guarantees regarding the accuracy or reliability of any results that may be obtained through use of the Service. You acknowledge and agree that we may, at any time and without notice, suspend or discontinue the Service for an indefinite period or cancel it entirely.

Your use of the Service or inability to use it is at your sole risk. Unless expressly stated otherwise, the Service and any products or services delivered through it are provided on an “as is” and “as available” basis, without any warranties, representations, or conditions of any kind, either express or implied. This includes, but is not limited to, implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Under no circumstances shall Helios Store be held liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind. This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Service or any products obtained through it. This also applies to any claims related to errors or omissions in content, or any loss or damage resulting from the use of any content or product shared, transmitted, or otherwise made available through the Service, even if we’ve been advised of the possibility of such damages.

In jurisdictions where limitations on liability for incidental or consequential damages are not permitted, our liability will be limited to the fullest extent allowed by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Helios Store from and against any claims, demands, liabilities, or expenses, including reasonable legal fees, brought by any third party as a result of your breach of these Terms of Service or any referenced documents, or your violation of any law or the rights of another party.

13. Termination

Any obligations or liabilities incurred by either party before the termination date will survive the termination of this agreement for all purposes. These Terms of Service will remain in effect unless and until terminated by either you or us. You may end this agreement at any time by notifying us that you no longer wish to use our Services, or by discontinuing use of our site.

We reserve the right, at our sole discretion, to terminate this agreement at any time without notice if we believe you have failed to comply with any term or provision of these Terms. In such a case, you will remain responsible for any outstanding amounts owed up to and including the date of termination, and we may also restrict or revoke your access to our Services (or any part of them).

14. Miscellaneous

These Terms of Service and any policies or operating rules posted by us on the Services or in respect to the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Service shall not operate as a waiver of such right or provision. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Service and does not affect the validity and enforceability of any remaining provisions. You agree that these Terms of Service will not be construed against us by virtue of having drafted them.
